TERMS OF REFERENCE
The purpose of this consultancy is to strengthen Papua New Guinea’s (PNG) juvenile justice system by supporting the comprehensive review and amendment of the Juvenile Justice Act 2014, with a view to ensuring compliance with international child rights obligations and reinforcing a child-centered, rights-based and restorative justice framework consistent with established global standards and good practices.
The assignment involves a comprehensive review and reform of the Juvenile Justice Act 2014, entailing a detailed legal and technical assessment to identify gaps relative to international standards, child-friendly justice principles, and institutional mandates.Key responsibilities:
1. Develop the overall framework for carrying out the review and revision of the Juvenile Justice Act 2014.
2. Provide technical support to relevant government entities to make formal application for a policy decision to revise and amend the legislation.
3. Conduct analysis of the Juvenile Justice Act 2014 to identify legal and procedural gaps.
4. Facilitate stakeholder consultations with relevant justice actors and Working Group meetings.
5. Prepare First Draft of the revised legislation, integrating findings from legal analysis and consultations.
6. Facilitate validation meeting(s) to review Draft and consolidate feedback from statutory authorities and stakeholders.
7. Prepare Final Draft of the revised legislation, incorporating feedback from validation meetings and legal authorities.
8. Support formal endorsement of the proposed amendments of the Juvenile Justice Act 2014 for submission through legislative channels.
